Terms and Conditions The HotBargainsUK reward scheme ("HotBargainsUK") is owned and operated by HotBargainsUK Limited ("The Company"). The terms "HotBargainsUK.com" and "the website" shall be taken to mean the main internet website used by The Company to operate the HotBargainsUK scheme, currently accessible at http://www.HotBargainsUK.com Acknowledgment & Acceptance By joining HotBargainsUK you ("The Member") agree that you have read and understood this Agreement ("Agreement") and that your HotBargainsUK membership shall conform to its terms and conditions. Your access to and use of HotBargainsUK ("the website") is subject exclusively to these Terms and Conditions. You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. If you do not accept these Terms and Conditions you must immediately stop using the website. For the avoidance of doubt, these Terms and Conditions shall be subject to the laws and jurisdiction of England. If any provision of these Terms and Conditions is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. You agree to remain bound by this Agreement (or such amended Agreement) for as long as you remain a Member or unless The Company terminates, suspends or otherwise limits access. Should The Member object to any of the terms and conditions of this Agreement, or any subsequent modifications thereto, or become dissatisfied with HotBargainsUK, the Member's only recourse is to immediately discontinue participation in HotBargainsUK and properly terminate his or her membership and cease using the website. Membership You must be a resident of the UK aged 16 years or older to open a HotBargainsUK account and receive Points. We will block all accounts which are opened or accessed from outside of the UK. Accounts are limited to one per person, and a maximum of 2 per household. HotBargainsUK reserves the right to refuse membership and reserve the right to terminate membership without notice at any time. The Member agrees to provide only true and accurate information to HotBargainsUK (including to its advertisers and partners) at all times, and to maintain accurate details on their account at HotBargainsUK.com. Advice There may be information contained on the website regarding investments and other financial services. No such information should be taken to constitute financial advice, and should not be relied upon for making, or refraining from any financial decision. Earning Points You must be logged into your account and use the HotBargainsUK links to accrue Points. As a verified member you will receive Points as a either a percentage of the amount you spend, or as a fixed reward amount for signing up to specific offers or taking advantage of other point earning opportunities as specified within the HotBargainsUK directory. Where the reward is stated as a percentage of a purchase, unless specifically stated otherwise, the Member should assume that the calculation of such percentages will exclude costs such as sales tax and delivery charges. Any transaction you make is with the retailer and not with HotBargainsUK. Points are rewarded when the retailer confirms your purchases. Depending on their returns policy this normally will be done within 30 days. However some retailers may take upwards of 45 days. It is your responsibility to ensure that you turn your cookies on with your browser, and that you do not have any software on your computer that may block your Points such as Norton internet security. If any of your purchases are returned to the retailer, any Points will automatically be deducted from your balance. Additionally if any leads / forms are filled in fraudulently or are incomplete the retailer and/or HotBargainsUK can invalidate your application. The Company is not responsible for changes to, or discontinuance of any Points-earning opportunity through its retailers, neither is The Company responsible for the inaccurate reporting of Points earned through a retailer by that retailer. The Member accepts that, in some cases, there may be a delay or failure to award Points due to a retailer’s failure to provide necessary information to The Company for the crediting of such Points. The Company will not be responsible or liable for the delay or failure to credit Points in such circumstances; however we will endeavour to ensure such instances are kept to a minimum. Adjustments The Company may from time to time adjust your Points account upwards or downwards in respect to accounting errors, non-payment from third parties, refunds issued, products returned or suspected fraud, for which The Company has full authority. Redeeming Points Points earned are reported against your account on HotBargainsUK.com, with a status of either "Pending" or "Awarded". Points may only be redeemed once they attain a status of "Awarded" (i.e. when payment related to the earning of those Points has been received in full by The Company from the participating retailer). You will not hold The Company responsible for the failure to collect monies due in relation to your Points membership, nor the removal of Points from (or failure to award Points to) your account for this reason. The Company reserves the right to limit the redemption of specific rewards and limit the number of rewards available at any particular point-spending level. Points will be subtracted from The Member's account once the reward is sent. Once used to claim a reward (i.e. a withdrawal), Points will not be reinstated to The Member's account. All redemptions are subject to a minimum Points value, as published on HotBargainsUK.com. This threshold may vary from time to time, and according to the method of redemption, and any special promotion terms at registration. Points are valid for 2 years from the date of being awarded and must be redeemed within those 2 years. The Company reserves the right to remove all Points awarded that are older than 2 years. Claims/Disputes Any queries in regards to HotBargainsUK can be raised with us by using the various members contact forms, or alternatively by contacting us with the information in the ‘Contact Us’ section. Members should not under any circumstance contact our retailers themselves with any issues in relation to points; this is the sole responsibility of The Company. All interpretations of these terms and conditions shall be at the sole discretion of The Company. In the event of an error by The Company your sole recourse will be the crediting of any disputed Points. Dormant Accounts In the event that your HotBargainsUK account is dormant (showing no transactions) for a period exceeding 24 months then we reserve the right to terminate your account. Any points owing will thus be forfeited. Tax You are solely responsible for assessing any tax implications that may arise through redeeming Points under the HotBargainsUK scheme, and for the payment of any said taxes. Transfers Points may not be transferred to other accounts nor pooled together in any manner. The sale or barter of Points is strictly prohibited by The Company. Termination The Member or The Company may terminate the member's membership with or without cause at any time. Membership immediately ceases upon termination and any unredeemed Points shall be cancelled. The Company shall be the sole determiner in cases of suspected fraud or violation of its terms and any decision it makes relating to termination of membership (including cancellation of Points) shall be final and binding. In the event that a Member expressly requests to leave HotBargainsUK, no further communication will be entered into between The Company and the Member. Once membership is terminated, The Member must redeem any points (subject to these Terms and Conditions) within 60 days; after this time, any points not redeemed will be cancelled. Other Membership Facilities The Company provides additional facilities on HotBargainsUK.com, not directly related to the earning and redemption of points, such as; discussion forums, private messaging and other means of inter-member communication. The Member should use such facilities in accordance with the Terms and Conditions and guidelines as published on HotBargainsUK.com. The Company reserves the right to withdraw such facilities from an individual Member either temporarily or permanently and / or terminate their membership, in the event that The Member's use of such facilities is in breach of these Terms and Conditions or otherwise contrary to the interests of HotBargainsUK. Note that The Company accepts no responsibility for the accuracy or otherwise of communications made by other Members using these facilities. Complaints about such communications should be made in writing to The Company at its head office. Access and security Each member joining HotBargainsUK will register under their username and password, which should not be disclosed to ANY third party. For authorisation and redemption purposes, you will be required to identify yourself through your username or Real name. For the avoidance of doubt, any individual logging in with a correct username and password will have full access to that account, and it is the sole responsibility of the account holder to ensure that this information is not made available to unauthorised individuals. Any infringement of this condition may result in immediate termination of membership. Access to your account is password protected and we never release details of this to third parties. Details are only released when we receive an email from the email account of the member. If you have forgotten your password, please use the 'Password reminder' facility on HotBargainsUK.com to request your password and username. Note: You should NEVER reveal your password to anyone. No employee or agent of The Company will ever ask you to reveal your password. The Company cannot be responsible for any activity in your account which results from a member not keeping their password secure. Copyright All copyright, trade marks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to HotBargainsUK or otherwise used by HotBargainsUK as permitted by law. In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only, limited at a maximum of 5 pages of A4 paper. Disclaimers and limitation of liability The Website is provided on an "as is" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. The Company does not make any warrant, guarantee, or make any representations regarding the quality of, or assurance of any advertisement or any merchandise, products, or services offered or provided by third party companies participating in the HotBargainsUK scheme. To the extent permitted by law, HotBargainsUK will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. HotBargainsUK makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of HotBargainsUK for death or personal injury as a result of the negligence of HotBargainsUK or that of its employees or agents. Indemnity You agree to indemnify and hold HotBargainsUK and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against HotBargainsUK arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website. Severance If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable. |
